Row Over ‘Technically Accurate’ Consumer Report Headed to Jury

A background check reporting company was denied judgment on the pleadings because a question of fact remains and requires a jury trial, a federal judge said.

Kiana Okamura sued Rental Research Services Inc. for allegedly violating the Fair Credit Reporting Act by failing to follow a reasonable procedure that ensured maximum possible accuracy of her tenant screening report. Okamura says her application to lease an apartment was denied after Rental Research’s report allegedly included a civil eviction and judgment record for her sister, Kiarah Okamura.
