Two Rosati Franchise Systems Inc. shareholders will have to stop selling Rosati-branded frozen pizzas to grocery stores, after the U.S. District Court for the Northern District of Illinois said the activity ran afoul of their RFSI licensing agreement.
The plaintiffs, two other RFSI shareholders, are likely to succeed on their claims that the frozen pizzas infringe on RFSI’s intellectual property rights, Judge John F. Kness said in the Wednesday ruling.
The “most natural reading” of the licensing agreement “is simple and direct,” Kness wrote for the court.
