Rockwell Counterfeit Suit Survives Supreme Court Trademark Test

Rockwell Automation Inc. can raise allegations of overseas counterfeit sales in its suit against Parcop SRL despite the US Supreme Court’s recent decision to curtail the global reach of US trademark law, a federal court ruled.

The US District Court for the District of Delaware said Tuesday that Parcop, a spare parts provider that does business as WiAutomation, overstated the high court’s holding in Abitron Austria GmbH v. Hetronic International, Inc. when it alleged that Rockwell was prohibited from relying on evidence of foreign counterfeit sales at trial.
