Rocket Mortgage LLC can pursue arbitration as part of a terms of use agreement a consumer signed and sued over, a federal appeals court said.
A district court improperly concluded that Michael Dahdah’s clicks accepting the terms didn’t create an enforceable agreement, the US Court of Appeals for the Sixth Circuit said in a Monday opinion reversing and remanding the lower court’s arbitration denial.
