A putative class action lawsuit alleged the company used its Rx Savings Program to overcharge customers with public or private insurance for generic drugs.
The two customers, Bryon Stafford and Robert Josten, whose suits were consolidated, argued that Rite Aid illegally reported higher than their “usual and customary” generic drug prices to insurers, resulting in higher co-payments, and in insured customers paying more than customers who paid in cash.
