Rite Aid Pain Reliever Label Change Settlement Gets Early Nod

Rite Aid Corp. and consumers Wednesday secured a California federal judge’s early approval of a class settlement under which the company will stop touting certain pain relievers as “rapid release,” resolving deceptive marketing allegations.

The settlement provides meaningful benefits to the class in the form of nationwide injunctive relief, Judge Yvonne Gonzalez Rogers of the US District Court for the Northern District of California said.

Thomas Bailey and Jamal Erakat alleged the retail chain misleadingly portrays its Rapid Release Gelcaps as providing faster relief than regular acetaminophen products, which cost less. Consumers allegedly paid extra because of the products’ portrayal. ...
