Human resources software company Ripple Analytics Inc. lost its trademark infringement claim against another HR software company because it doesn’t own the trademark it alleged.
It sued People Center Inc., which does business as Rippling, for trademark infringement and unfair competition in 2020, alleging confusion between marks for “ripple” and “rippling,” respectively.
But Noah Pusey, the company’s CEO, is the real party in interest, because he actually owns the trademark, and the company’s lawyers bizarrely rebuffed multiple attempts to get him to join the litigation, the US District Court for the Eastern District of New York said Wednesday.
