Reynolds Fails to Defeat Class Action Over ‘Made in USA’ Foil

A consumer challenging Reynolds Wrap’s claim to be “Made in the USA” adequately alleged she suffered injury by paying a premium for the product in violation of state law, a federal court said.

Anaya Washington’s proposed class action can continue since she met the appropriate standard to allege Reynolds Consumer Products LLC acted deceptively under New York General Business Law, according to a Monday opinion and order. Judge Andrew L. Carter Jr. denied Reynolds’ motion to dismiss the proposed class action from the US District Court for the Southern District of New York.
