Revlon Loses Bid to Dismiss Some Cancer Claims With Prejudice

A federal judge rejected a request from Revlon Inc. to dismiss with prejudice all cases alleging cancerous injuries tied to use of the company’s hair relaxer products just because those plaintiffs lack a cancer diagnosis.

Judge Mary M. Rowland of the US District Court for the Northern District of Illinois agreed that “a plaintiff being forever barred from filing a claim based on an actual diagnosis of cancer is too severe given the failure to investigate, in light of the stage of the proceedings and degree of prejudice to the Defendants.” But since a case asserting a cancerous injury is ...
