Recreational Equipment Inc. defeated a proposed class action alleging it deceptively markets waterproof clothing as safe and sustainable when they contain per- and polyfluoroalkyl substances.
Jacob Krakauer lacked standing to sue the company because he didn’t test the jacket he purchased, or the same model, for PFAS, the US District Court for the Western District of Washington said March 29. Krakauer also couldn’t show he overpaid for the jacket because he didn’t allege facts about alternative products that were available.
