Reassigned SSA Worker’s Bias Suit Revived Under New SCOTUS Test

The Social Security Administration’s reassignment of a branch manager to a nonsupervisory role could be adverse job action under a new Supreme Court test, the Fourth Circuit ruled, reviving her disability discrimination claims.

The decision is the latest example of a worker finding support for an employment bias claim under a standard the justices clarified last year. Judges have been busy applying the new test since the Supreme Court’s decision was handed down.
