Stars of the reality television show “Diesel Brothers” may see a $760,000 penalty for tampering with emission-control devices reduced after the Tenth Circuit ordered a Utah judge to reconsider the seriousness of their violations Tuesday.
The U.S. District Court for the District of Utah didn’t give proper weight, if any at all, to Congress’s judgment, the appeals court said.
The maximum penalty set by Congress was $2,500, according to the U.S. Court of Appeals for the Tenth Circuit. Violating requirements in state plans to reduce pollution may see higher penalties, the court said.
