Luxottica had an investigator purchase several pairs of sunglasses from MySpecs Ltd, and each of the items allegedly had counterfeit Ray-Ban trademarks, leading it to file a trademark infringement suit in the US District Court for the District of Arizona. MySpecs said the case should be dismissed because Luxottica failed to link the sunglasses to the online storefront, failed to allege consumer confusion, and failed to identify which trademarks were allegedly infringed.
