Raising Cane’s Beats Bid to Send Wage Suit Back to State Court

Raising Cane’s defeated a worker’s attempt to have a proposed class wage-and-hour suit remanded to state court after the company removed it to a federal forum.

The fried chicken chain established that there’s more than $5 million at stake, satisfying the Class Action Fairness Act’s jurisdictional requirements for removing the state-law suit to federal court, the US District Court for the Central District of California said.

The worker accuses Raising Cane’s USA LLC and parent Raising Cane’s Restaurants LLC of violating California laws on overtime, minimum wages, meal and rest breaks, timely pay, wage statements, and business expense reimbursements. ...
