Railroad Workers Fail to Qualify for FMLA Class Certification

A proposed class of Kansas City Southern Railway Co. railroad workers were denied class certification after a district court ruled their claims of family medical leave violations were too dissimilar.

The seven plaintiffs failed to satisfy the commonality requirement of Federal Rule of Civil Procedure 23(a)(2) for class certification, Judge Roseann A. Ketchmark of the US District Court for the Western District of Missouri said Wednesday in an order. The allegations against the railway company’s Family Medical Leave Act leave calculation policy isn’t a basis to satisfy commonality, the court said.
