Quadriplegic Gets New Malpractice Trial Against Spine Surgeon

An Arizona trial court erroneously excluded evidence that could have helped a spinal surgery patient prove that her surgeon’s alleged negligence led to her complete paralysis, a state appeals court said.

Brooke Amick will get a new trial against physician John Iskandar, the Arizona Court of Appeals, First Division, said Tuesday. The trial court improperly applied Arizona’s one-expert rule to exclude the testimony of a treating neurologist who’d been called in to evaluate Amick after the surgery and evidence about a second surgery that contradicted Iskandar’s causation theory, the court said.
