Psychology Today Publisher Is Person Under CIPA, Court Rules

Psychology Today’s publisher, a limited liability company, was unsuccessful in convincing a federal judge that as a LLC, it couldn’t be held liable for a California privacy claim stemming from its use of Google Analytics.

Sussex Publishers LLC argued that for the sake of a California Invasion of Privacy Act claim, the US District Court for the Northern District of California should either adopt a dictionary’s definition of person—a human being rather than a legal entity—or use the term as defined elsewhere in the state’s penal code—which includes corporations and natural persons, but not LLCs.
