PruittHealth Worker’s Negligence Claim From Data Breach Advances

PruittHealth Inc. failed to convince a federal court to dismiss a negligence claim after a judge ruled that a former worker sufficiently alleged the healthcare provider had a legal duty to protect her personal data.

But the worker couldn’t advance negligence claims predicated on the Health Insurance Portability and Accountability Act or the Federal Trade Commission Act, the US District Court for the Northern District of Georgia said Monday. The court also dismissed the worker’s breach of fiduciary duty claim.
