Parents who say Hain Celestial Inc. unlawfully makes front-label nutrition claims for products intended for children under two will likely need to narrow their class definition before their claims are certified, a federal judge suggested.
During a class certification hearing on Thursday, Judge Vince Chhabria, of the US District Court for the Northern District of California, said he thought there was a “disconnect” between the parents “theory of recovery and theory of liability” since parents of children over the age of two also purchased the products.
