Progressive Agrees to Pay $19.2 Million to End ‘Total Loss’ Suit

Progressive Direct Insurance Co. has agreed to pay $19.2 million to resolve claims that it underpaid Washington policyholders whose cars were declared total losses after accidents, according to a motion for preliminary approval of the settlement filed in federal court.

The proposed settlement, filed on Tuesday in the U.S. District Court for Western District of Washington, seeks to certify a settlement class comprising anyone insured by Progressive’s “first party personal line” Washington auto insurance policies who received a total loss claim valuation reflecting a deduction called a “projected sold adjustment.”
