Professor Gets Second Shot at Retaliation Suit Against College

A Reno, Nevada, community college professor is entitled to replead due process and equal protection claims against the school he says retaliated against him for publicly opposing a curriculum change, a US appeals court said Monday.

A lower court erroneously ruled that Lars Jensen’s First Amendment claims against Truckee Meadows Community College administrators were barred due to sovereign and qualified immunity, the US Court of Appeals for the Ninth Circuit ruled. The appellate court ruled that Jensen sufficiently alleged that his right to free speech was violated when he was reprimanded for opposing the college’s new math curriculum standards. ...
