Federal corrections officers lost their bid for another chance to argue that the US owes them hazard pay for workplace coronavirus exposure after the US Supreme Court on Tuesday declined to consider their case.
The workers urged the high court to weigh in after the US Court of Appeals for the Federal Circuit, sitting en banc, ruled that a federal regulation on hazardous duty wages didn’t provide for Covid-based differential pay.
The appellate court’s 10-2 interpretation of the regulation was “blatantly wrong,” the workers argued in a May petition.
