Delaware County, Pa., must face trial on whether it discriminated against a long-time correctional officer by denying her an accommodation from its mandatory overtime rule and firing her.
A jury must weigh whether working mandatory overtime really was an essential job function for all correctional officers at the George Hill Correctional facility after the county took over operation from a private contractor, the US District Court for the Eastern District of Pennsylvania said. The county made that move because of staffing issues at the facility, the court said.
