Printify Defeats Preliminary Injunction During Trademark Suit

Atari Interactive Inc., a video game company that licenses its trademarks for merchandise, failed to convince a federal judge a preliminary injunction against Printify Inc. was necessary as its infringement suit progresses.

The US District Court for the Southern District of New York said Atari failed to show it was likely to succeed on the merits of its trademark infringement and dilution claims or that it would face irreparable harm in the absence of an injunction.

Atari says Printify, a print-on-demand provider, participated in infringing its marks when Printify’s customers added its trademarks to Printify’s image database.
