Prime Hydration Wiretapping Class Action Remanded to State Court

Energy-drink maker Prime Hydration LLC will face a lawsuit in state court alleging it allowed Meta Platforms Inc. and Google LLC to collect information arising from consumer interactions with its website in violation of the Pennsylvania Wiretapping and Electronic Surveillance Control Act.

The US District Court for the Eastern District of Pennsylvania didn’t have jurisdiction over the proposed class action because lead plaintiff Shantay Heaven didn’t show that she had suffered a concrete injury sufficient for Article III standing to sue in federal court, Judge Nitza I. Quiñones Alejandro said Tuesday.
