Primal Nutrition LLC convinced a federal judge to toss a proposed class action alleging its avocado oil was deceptively advertised as “pure” despite allegedly containing dangerous chemicals.
The complaint cited a report that said laboratory testing found Primal Kitchen avocado oil contained chemicals called phthalates, but “it is not clear how the testing was conducted, who performed the testing, or what specific results were obtained,” Magistrate Judge Stanley A. Boone of the US District Court for the Eastern District of California said. He dismissed the complaint Wednesday with leave to amend within 30 days.
