A child allegedly injured by medical care she received at a hospital’s neonatal intensive care unit will get a new trial because of an attorney’s improper inflaming of the jury during closing argument, Rhode Island’s top court said.
The closing argument, in which an attorney for Women & Infants Hospital of Rhode Island told a jury to “send a message” to the hospital that it should continue taking in the sickest children, likely caused prejudice that prevented the jurors from reaching a fair and impartial verdict, the Rhode Island Supreme Court said.
