Massachusetts delivery drivers who say Postmates Inc. misclassified them as independent contractors instead of employees asked the First Circuit to undo a lower court ruling sending their dispute to arbitration.
The district judge wrongly concluded that a Federal Arbitration Act exemption for transportation workers who move goods in interstate commerce didn’t apply to the drivers, whose arbitration agreements should be unenforceable under state law, according to a brief filed in the US Court of Appeals for the First Circuit.
