Two Delaware state police officers are immune from a due process suit brought by a security firm claiming that they improperly suspended its license without a hearing, the Third Circuit said Friday in a reversal.
International Security LLC alleged the police officers had no cause to invoke the emergency exception to the notice and hearing requirements of the state’s Private Investigators and Private Security Agencies Act.
