A police benevolent association has associational standing to be part of a First Amendment suit challenging a Pennsylvania township’s decision to ban use of the thin blue line American flag by on-duty employees, a federal trial court said.
The Pennsylvania State Lodge Fraternal Order of Police, the Springfield Township Police Benevolent Association, and three Springfield police officers sued the township over the ban. The township acknowledged that the individual officers had standing, but argued that the organizations didn’t. A memorandum opinion filed Tuesday by Judge Karen S.
