New York law enforcement personnel can, without a warrant, inspect commercial vehicle and driver data during roadside safety inspections, all seven judges in New York state’s highest court concluded.
Warrantless inspections don’t constitute an unreasonable search and seizure under the US Constitution, the court said in the June 13 opinion, written by Associate Judge Shirley Troutman.
The high court’s decision upholds a lower court ruling from March 2022.
