Polaris Must Face Suit Over Youth ATVs with Steering Defect

Polaris Inc. must continue defending a suit over youth all terrain vehicles that were recalled due to a problem with the steering system, a federal judge said.

The consumer’s diminution-in-value claim wasn’t prudentially moot because it sought relief not provided by the Consumer Product Safety Commission’s 2023 recall of the vehicles, the US District Court for the District of Montana said Tuesday, adopting a magistrate judge’s recommendations.
