A Pizza Hut franchisee with over 300 locations escaped most of the allegations brought by a collective of delivery drivers who say the company fails to pay them the federal minimum wage.
All but one of the suing delivery drivers lack personal jurisdiction to bring their Fair Labor Standards Act collective action against Ayvaz Pizza LLC since they don’t live or work in Virginia, Judge Jasmine H. Yoon said Aug. 22. Each of the suing drivers also failed to establish that the district court has personal jurisdiction to hear claims against the company’s owner, Shoukat Dhanani, necessitating dismissal.
