Pirate Shipwreck Merger Appeal Fails at Delaware Supreme Court

Delaware’s top court affirmed Tuesday an order to unwind a merger of ventures related to an 18th-century pirate shipwreck.

A shareholder who successfully challenged the combination of entities founded to recover and commercialize treasure from the wreck of the Whydah Gally had sought further remedies from the Delaware Supreme Court.

A one-page order signed by Justice N. Christopher Griffiths upheld a Delaware Chancery Court ruling from May 2024. The Delaware Supreme Court’s full five-member panel considered the appeal, but the order didn’t elaborate on their reasoning.
