Physician Gets Split Decision in Disability Discrimination Suit

A Pennsylvania doctor failed to show a walk-in patient care clinic firing him violated federal disability bias laws but can move forward on a claim that his former employer refused to accommodate an alleged disability.

Patient First Pennsylvania Medical Group PLLC was entitled to judgment before trial on Brent Nickischer’s disability discrimination and retaliation claims because he failed to refute the clinic’s legitimate nondiscriminatory reason for ending his employment, the US District Court for the Eastern District of Pennsylvania said Monday.
