A paralegal in the Philadelphia District Attorney’s office may conditionally proceed with her collective action alleging that she and other paralegals aren’t paid overtime because they’re improperly classified as exempt administrative employees, a federal court said.
Conditional certification of Marybelle Fayad’s Fair Labor Standards Act collective action can proceed, because the proposed class was ascertainable, sufficiently big, and had a common question—whether the DA’s office “misclassified its paralegals as exempt from overtime eligibility,” Judge Joshua D.
