PharmaCare Laboratories Exits Sambucol Tablets False-Ad Lawsuit

Australia-based PharmaCare Laboratories Pty Ltd. convinced a federal judge to dismiss it from a lawsuit alleging the company’s Sambucol Black Elderberry Chewable Tablets were deceptively labeled.

Consumers alleged PharmaCare Laboratories and its American unit, PharmaCare US, marketed the tablets as developed by a “world renowned virologist” and containing a “unique black elderberry extract.” They seek to represent California and New York consumer classes.

The California consumers failed to show PharmaCare Laboratories had sufficient contacts with the state, the US District Court for the Southern District of California said May 10.
