A former Peterson’s Oil Service Inc. worker can again accuse the company engaging in unlawful discrimination by firing him for his knee injury, the US Court of Appeals for the First Circuit said.
The oil service technician’s claim claim can proceed because he sufficiently alleged that his injury prevented him from conducting life activities such as bending his knee, Judge Julie Rikelman said in a Thursday opinion partially reversing the district court’s dismissal.
