Penske Interfered With Ex-Worker’s FMLA Rights, Jury Says

Penske Logistics LLC interfered with a worker’s right to take medical leave before the company fired him in 2021 for allegedly violating its attendance policy, a jury in federal court said.

The jury found that the logistics company interfered with then-warehouse lead Kevin Martin’s right to take time off under the Family and Medical Leave Act — which grants workers rights to take leave for serious medical conditions — after Martin was involved in a car accident in 2021.

The jury also awarded Martin $75,000 in wages and other compensation due to his termination from the company.
