Pennsylvania courts must preside over suits arising out of nursing home Covid 19-related injuries and deaths because no diversity exists among the residents and nursing home administrator defendants, and the federal public health emergency law doesn’t apply, a federal trial court said.
The Pennsylvania residents who filed state-law personal injury and wrongful death suits against Broomall Operating Co. had “self-evident” good-faith reasons for adding other Pennsylvania residents as defendants in the cases, the U.S. District Court for the Eastern District of Pennsylvania said.
