Penalty for N.Y. Man Convicted in Dumping Conspiracy Slashed

A New York man convicted of conspiring to dump contaminated waste in 2013 will pay a reduced penalty to resolve the federal government’s Superfund claims against him, according to the Northern District of New York.

The federal government determined Cross Nicastro of Frankfort, N.Y., had limited financial ability to pay his individual criminal restitution of $300,000. Restitution was stipulated after he was indicted on charges of conspiracy to defraud the U.S. and knowingly committing other offenses against the U.S. related to the Frankfort Asbestos Superfund site.
