PediaSure Fails to Bounce Lawsuit Over Kid Growth Label Claims

A grandmother suing Abbott Laboratories over an allegedly misleading statement on its PediaSure drink that she purchased for her grandson can proceed with her suit, a federal judge said.

Joanne Noriega filed a proposed class suit alleging that PediaSure’s marketing claim that the Grow and Gain Drink has been “clinically proven to help kids grow” in height is misleading. Noriega made methodological critiques of studies on which Abbott said it relied, cited published literature critiquing such studies, and cited “three studies funded by Abbott itself which did not find a connection between PediaSure and growth in height,” the Southern District ...
