Texas Attorney General Ken Paxton’s lawsuit against the city of Austin for its policy prohibiting the prosecution of marijuana possession was dismissed by a state judge on Wednesday, ruling the AG’s suit lacked jurisdiction.
Travis County District Judge Jan Soifer granted Austin’s jurisdictional plea, dismissing Paxton’s legal challenge against the Texas capitol with prejudice and without leave to amend the complaint. Soifer‘s order also denied the attorney general’s bid for an injunction to temporarily restrain the city from enforcing its prohibition on marijuana possession prosecution.
