Servers at the well-known Patsy’s Italian Restaurant Inc. in Midtown Manhattan can pursue their overtime and tip pool claims as a collective, a federal magistrate ruled.
Magistrate Judge Henry J. Ricardo granted in part the servers’ motion for certification on Monday in the US District Court for the Southern District of New York after ruling that the nine named workers or ex-workers sufficiently demonstrated they and potential collective members were subjected to a “common policy” of not being properly compensated for overtime work.
