Patient Must Produce Records in Fertility Center Fraud Suit

A Colorado fertility center can look at a patient’s previous medical records because they’re potentially relevant to her claims that it misrepresented the odds of her becoming pregnant using IVF, a federal court in the state said.

The patient must produce medical records related to her infertility issues from 2014 through 2018, the U.S. District Court for the District of Colorado said.

The court agreed with Colorado Center for Reproductive Medicine LLC that records predating its treatment of the patient are relevant to evaluating whether the provider falsely or negligently misrepresented her chances of success using in vitro fertilization.
