Passenger Lacks Standing to Sue KLM Over Climate Statements

KLM Airlines won dismissal Tuesday of a proposed class suit alleging it entices consumers with misleading promises about its commitment to limit the effects of climate change.

Lead plaintiff Kandus Dakus lacks standing to sue because she can’t show she relied on KLM’s statements and therefore can’t show injury, the US District Court for the Southern District of New York said.

Dakus alleged she chose KLM rather than another airline because of the alleged misrepresentations, and said she otherwise wouldn’t have bought the ticket or paid the asking price.
