Papa John’s Defeats Suit Over Session Replay Software on Website

Papa John’s International Inc. defeated a proposed class action alleging it used session replay software on its website to record the activities of website visitors in violation of Maryland law.

Plaintiff Frances Curd alleged in the lawsuit that Papa John’s wiretapped the electronic communications of visitors to its website in violation of Maryland statutory and common law.

But Curd failed to show that Papa John’s, a foreign corporation, had sufficient contacts with Maryland for the US District Court for the District of Maryland to have jurisdiction over the dispute, Judge Julie R. Rubin said Sept. 19.
