Papa John’s International Inc. defeated a proposed federal class action alleging it tracked user interactions with its website in violation of the California Invasion of Privacy Act.
Plaintiff Dacia Thomas alleged that Papa John’s installed session replay tracking code on its website, allowing the restaurant chain to capture and recreate her interactions with the site without her consent.
The lawsuit is part of a recent surge of lawsuits, many under state wiretap laws, challenging the use of session-replay software to track users’ online behavior. Prominent defendants include Lowe’s, Zillow, Expedia, and Autozone.
