Pace Actors Studio Avoids Liability for Covid-19 Class Changes

Pace University isn’t liable to a student, who sought his master’s degree in the performing arts at its Actors Studio Drama School in New York City, for changes it made to his schedule during the Covid-19 pandemic, the Second Circuit said.

Brett Goldberg failed to state a viable breach of contract claim, the Thursday opinion by Judge Susan L. Carney said, affirming the district court’s dismissal of the suit on the pleadings.

Goldberg was finishing up his degree when Covid-19 caused the school to place the Spring 2020 Repertory Season on hold, including a production of a play Goldberg wrote. ...
