P&G Loses Bid to Dismiss Class Action Over ‘Pure Cotton’ Tampons

A federal judge denied Procter & Gamble Co.‘s attempt to dismiss one of several proposed class actions alleging the company mislabeled tampons that contain harmful chemicals as pure organic cotton.

The suit has standing because “each Plaintiff alleges that she relied on P&G’s representations about the Tampon Products and ‘would not have purchased the Products, or would not have purchased them on the same terms, if the true facts had been known,’” Judge Araceli Martínez-Olguín, of the US District Court for the Northern District of California, wrote in a Tuesday opinion.
